TEMPORARY RESIDENCY

Temporary residence is the first step for a foreigner to live in Chile. It precedes permanent residence and is granted to foreigners with family ties or to individuals coming to Chile to invest, work, or live off their retirement funds and incomes, among other scenarios.
Temporary residence allows the visa holder to engage in any legal and paid activity during the visa period. This visa is usually granted for two years and can be renewed, if necessary, before the applicant can apply for permanent residence.
Currently, the temporary residence is requested through an online process managed by the National Migration Service, and the application can be made within the country for those with a direct connection to Chileans or permanent residents, or from abroad. In both cases, we are
qualified to assist our clients with the application process for temporary residence and guide them in gathering all necessary documents to ensure a successful application.
There are different types of temporary visas, each with different requirements. At The Law Offices of Simon Marin, we specialize in determining the right type of temporary visa to meet our clients' needs.
At the same time, many of our clients want to come to Chile with their families. The temporary residence in Chile can be granted to family members (spouse, children, and parents) as dependents, demonstrating their relationship with the main holder.
Also, some clients, despite their desire to settle in Chile, need to travel periodically for personal reasons or to maintain their businesses abroad. It is frequently asked if they can leave the country without losing the benefits of their temporary visa. At The Law Offices of Simon Marin we assist our clients so that, while their residence is being processed, they can leave the country and return as needed during the visa length. However, to apply for permanent residence, certain time requirements must be met during the temporary visa duration.
Therefore, we always plan with our clients who wish to apply for permanent residence the maximum absence times.
90 days before the expiration of temporary residence, the foreigner must decide whether to extend the temporary residence, apply for permanent residence, or leave the country. The requirements for applying for an extension of temporary residence or permanent residence are discussed before making a decision.
